THE LAST WILL AND TESTAMENT

I, John Alexander Smith, date of birth 1979-02-17, nationality American, holding passport number USA5678901 and Emirates ID number 784-1979-9876543-1, address Arabian Ranches 2, Dubai, UAE, contact number +971501234111, email address john.smith@example.com Being of sound mind and memory and over the age of twenty-one (21) years and not being actuated by duress, fraud, mistake, or undue influence, do hereby make, publish, and declare that this Will, including the revocation provision hereinafter contained, is made for the purpose of settling my properties situated or arising in the UNITED ARAB EMIRATES only. Any Wills or codicils made prior to this Will, relating to my estate in UAE are now cancelled.

a) The laws of the United Arab Emirates (UAE) applies.
b) The substantive provisions governing testamentary disposition and other dispositions taking effect after my death shall govern the provisions of this Will.

In my Will, where the context so admits "my Estate" shall mean all my property both movable and immovable, real and personal of whatsoever kind, situated in the United Arab Emirates over which at the time of my death I shall have any power of disposition, including but not limited to bank accounts (savings, current, fixed deposit, and any other accounts), motorcycles, motor cars, art, antiques, jewels, jewellery, furniture and fixtures, debentures, leasehold interests, bonds, security lockers, stocks, shares, investments, inheritances, mutual funds, capital, death-in-service benefits, gratuity payments, reserves, all insurance policies, any shareholding in any companies, and any other assets.

I direct my trustees to make payment of my lawful debts and funeral expenses and of the expenses of winding up my estate.

I appoint Jane Elizabeth Smith, date of birth 1981-08-04, nationality American, holding passport number USA2233445 and Emirates ID number 784-1981-1122334-2, address Arabian Ranches 2, Dubai, UAE and email address jane.smith@example.com to be my executor and trustee, but if he/she is unable or unwilling to act or if he/she dies before proving my Will, the following provision shall apply instead.

I appoint Noah Rahul Patel, date of birth 1978-12-02, nationality British, holding passport number GBR4455661 and Emirates ID number 784-1978-6677889-6, address Jumeirah Golf Estates, Dubai, UAE and email address noah.patel@example.com to act as my substitute executor and trustee.

I appoint Amelia Rose Bennett, date of birth 1980-10-25, nationality Australian, holding passport number AUS3344556 and Emirates ID number 784-1980-8899001-9, address Saadiyat Island, Abu Dhabi, UAE and email address amelia.bennett@example.com to act as my substitute executor and trustee.

If all of the above appointed executors and trustees die before proving my Will, I revoke their appointments and I make the above appointment instead.

I direct my trustees to give effect to any writings granted by me, however informal they may be, provided they are signed by me, dated after the date hereof and are clearly expressive of my intention, as to which my trustees shall be the sole judges.

I direct my trustees that all proceeds from any insurance policies shall be distributed according to the existing nomination/beneficiary form completed by me and in the absence of such form, the following beneficiary provisions of this Will shall apply instead. These policies include: Global Life Insurance (Policy No. GLI-90811); Pacific Mutual (Policy No. PM-44729).

Upon my demise, I appoint Sophia Marie Thompson, date of birth 1983-09-14, nationality Canadian, passport number CAN4455667 and Emirates ID number 784-1983-7788990-5, address Dubai Hills Estate, Dubai, UAE and email sophia.thompson@example.com to act as permanent guardian of my child/ren.

In the event of him/her predeceasing me or being unable or unwilling to act, then; I appoint Michael David Thompson, date of birth 1986-01-03, nationality Canadian, passport number CAN7788990 and Emirates ID number 784-1986-1122446-6, address Al Reem Island, Abu Dhabi, UAE and email michael.thompson@example.com to act as the permanent guardian of my child/ren, if they are under the age of full capacity at the time of my death.

However, if the appointed permanent guardian mentioned above is unable to act and take the custody of my child/ren for the interim period only, then; I appoint Priya Anita Nair, date of birth 1984-04-09, nationality Indian, passport number IND5566778 and Emirates ID number 784-1984-5566778-7, address Mirdif, Dubai, UAE and email priya.nair@example.com to act as the interim guardian of my child/ren, and in the event of her/him predeceasing me or being unable or unwilling to act I then appoint David Wei Chen, date of birth 1982-06-20, nationality Singaporean, passport number SGP8899001 and Emirates ID number 784-1982-2233445-8, address The Greens, Dubai, UAE and email david.chen@example.com to act as interim guardian of my child/ren. This interim guardianship appointment will apply until the permanent guardians will be able to act and take over the custody of my child/ren.

I direct my trustees to make over the whole residue and remainder of my Estate, as defined in this Will, nothing excepted, to the following beneficiaries:

I give to Jane Elizabeth Smith, date of birth 1981-08-04, nationality American, passport number USA2233445 and Emirates ID number 784-1981-1122334-2, address Arabian Ranches 2, Dubai, UAE and email jane.smith@example.com 40% of the residue of my Estate.

I give to Olivia Grace Smith, date of birth 2012-05-28, nationality American, passport number USA9988776 and Emirates ID number 784-2012-5566778-3, address Arabian Ranches 2, Dubai, UAE and email olivia.smith@example.com 30% of the residue of my Estate.

I give to Ethan James Smith, date of birth 2015-11-10, nationality American, passport number USA6677889 and Emirates ID number 784-2015-3344556-4, address Arabian Ranches 2, Dubai, UAE and email ethan.smith@example.com 30% of the residue of my Estate.

For the avoidance of doubt, the following provisions apply to the residue:

a) In the event that any of the above beneficiaries predeceases me, their respective share shall be distributed according to UAE intestacy laws.

b) If any part of the residue of my Estate falls to a beneficiary who has not attained the age of twenty-one (21) years, my trustees shall hold the same in trust for this beneficiary until the age of twenty-one (21) years is attained.

c) Income arising from such share shall be accumulated but my trustees may apply all or part of the income or capital of this share for the maintenance, education or benefit of this beneficiary.

d) In the event of any of the foregoing shares of the residue remain indisposed of by the preceding provisions, such share shall be distributed to the other beneficiaries pro rata according to their shares.

If any part of my estate is held for a beneficiary who lacks full legal capacity, my trustees shall have the following powers:

a) To pay or apply any part of the income or capital falling to that beneficiary for his or her benefit in any manner my trustees think proper.

b) To retain the same until such capacity is attained, accumulating income with capital.

c) To pay over the same to the legal guardian or the person for the time being having the custody of that beneficiary, whose receipt shall be a sufficient discharge to my trustees.

d) My trustees shall have the fullest powers of retention, realisation, investment, appropriation, transfer of property without consideration, and management of my estate as if they were absolute owners and not trustees, however all proceeds are for the interest of the beneficiaries only.

e) My trustees may appoint one or more executor of their own number to act as solicitor or agent in any other capacity and allow that trustee the same remuneration, as to which that trustee would have been entitled to if such appointment is made.

Where the context requires, the singular shall include the plural, the plural shall include the singular, and any gender shall include all other genders.

Finally, I declare that my country of domicile is United States of America, and I am residing in the United Arab Emirates at the time of signing this Will.
